Jason Beer KC cross-examining Mr Jarnail Singh

worth a watch

he is a formidable advocate

Yep he's very good.

The witness, Singh, is dreadful.  But what are the consequences of him giving terrible evidence?  I don't see where all this is heading.

The witness is dreadful only because he's basically bang to rights and has no choice but to come out with dog-ate-my-homework type excuses. Everyone knows it - he just doesn't want to admit it.

Loved the exchange that basically went:

Singh: I don't understand what you are suggesting to me.... and I deny whatever it is that you're suggesting.

Beer: I haven't suggested anything yet.

Singh: Ok then suggest something [so that I can deny it].

yeah but ok he is bang to rights maybe...but, again, what will come of it.  We all know the PO screwed up...other than making them squirm in the witness box what else will happen?

There are various police investigations ongoing of different people (like the Fujitsu engineer who wrote a report saying there were problems with Horizon and then 9 days later signed a witness statement saying there were no problems with Horizon).

I don't know if this particular guy is under police investigation but evidence is still coming out so there's a good chance he will be eventually if he isn't yet

Listened to several hours of Mr Singh’s evidence (or complete lack of it..) today.

Hard to explain just how badly he came across. The only reasonable view you could form is that he was lying and deliberately vague to try and prevent criminal proceedings against himself. I suspect he failed.

It must have been (you’d hope it was) humbling for him but that’s not enough for him and some of the others. Prosecutions have to follow this.

Recommend people watch as much of the whole enquiry as they can. It’s a complete lesson in corporate and legal irresponsibility and buck passing.

Genuine question: can a witness not refuse to attend on the basis of the privilege against self incrimination? Or do they have to raise that in response to specific questions?

Singh is right at the centre of the criminal cases. He has clearly been advised he has to say he wasn’t aware of anything and that he just did what his line manager said. Compared to previous witnesses he is not very bright, and also there is a lot of very damning evidence putting him in the frame. And the previous witnesses have also pointed the finger at him. Where it went really wrong is that he showed so clearly that he had been told what to say and was so desperate to say it, he pre-empted JB’s questions (“you’ve just answered a questions I haven’t asked yet” - printing emails for example).
