Often surprised people use this in court as attempted mitigation (cf Andy Burnham) as it strikes me as admission of driving without due care if you are unaware of the speed limit (might be being harsh here).
Have you ever missed a turn? Or misread a sign? Is that driving without due care and attention. Hope you're not one of those traffic cops they have on Channel 5.
I'm still annoyed at getting three points in the nineties for doing 42 in a 30. A dual carriageway had inexplicably been made a 30 zone. I asked the officer if it was an accident hotspot. She said no. Cash machine policing.
When a copper pulls you over because your brake light's gone just plead the fifth. None of this 'oh sorry officer I didn't realise'. I know my rights. I shall not be subjected to Jim's anal cavity search.
If it's the usual thing i.e. big red circles over every lane then it is total bollocks. That being said the fact this country has burned its cash on these shitty enterprises creating refuge free death zones instead of spending it on public transport is a disgrace.
Top tip - even if there is no variable sign the cameras still have a trigger if you exceed the motorway speed limit significantly.

Is the difference between mitigation and defence.

But surely it’s not even mitigation if it’s an admission to another (arguably more serious) offence?

Arguably worse to admit you knowingly and recklessly drove above the speed limit.

So consensus is I’m being overly harsh.

I think it's non-endorsable isn't it?

Due care is endorsable and the FPN is higher then speeding FPN (although obviously depends how much in excess of the speed limit you are).

Just pay your fine and move on.
Do the crime, pay the time (or 3 points and slightly higher insurance)

He was doing 78mph. He was speeding regardless of the variable speed limit. That only went to severity.

Those variable limits are a danger though, especially when they change so much as you go, it's incredibly distracting.
If they flash up as you approach and you'd have to break to reduce for them, do they give you leeway? Its safer to slow down gently.
It was still 78 on a motorway he should know is littered with cameras so I'm not sympathetic, despite being a fan of his generally.

It’s a bit harsh, Jim. Perfectly possible to miss a change in speed long because you’re concentrating on something else on the road, for example.
