Yes. this is an issue actually. The Dutch, who are famously relaxed with soft drugs, have banned it because usage got out of control and uses were causing heaps of car crashes etc.

Dunno, our government's own risk assessment re RTAs and deaths reads thusly:  

4.4. Deaths from traffic accidents associated with nitrous oxide have been mentioned as a possibility but thus far no specific cases have been reviewed globally (EMCDDA, 2022; Long, 2019).

4.5. There are currently no available UK data on the number of road traffic accidents associated with nitrous oxide use, or data on mortality from these. This is due to current difficulty with data recording and detection of these incidents.

While every drug-related death is a tragedy, the current number of annual deaths related to nitrous oxide remains low when compared to other drugs and comparable to other volatile compounds and solvents. In 2020 there were 3 deaths associated with nitrous oxide, 62 with benzodiazepines (Class C), 3 with solvents and 19 with fuels. Between 2001–2020, there were 56 deaths associated with nitrous oxide, 2,041 with benzodiazepines (Class C), 47 with solvents and 426 with fuels.

It’s almost impossible to prove impairment through NO. There is no readily accessible toxicology. 

It's the many balloons or capsules in the Golf wrapped around a tree or parked at its roof that gives it away.

Quite or, more on point, what justification is there for making nos illegal but not cigarettes? Smoking is far more anti-social, causes vast amounts of litter and the harm caused is a level of magnitude above nos.
