There are two types of criminal case in Scotland - summary and petition. Petition is used for the more serious crimes that can carry a heavier sentence (max you can get on summary is one year).

TBH this stinks of overcharging by the Crown to me
I loathe the man BTW but two things really stick out for me as sus.
1. The timing vs the multiple sexual assault charges. Why, if there was as many as two dozen charges, didn't this happen months (or even years ago)?? I reckon quite a few of these will be whittled away at early stages of the Defence.
2. Breach of the Peace! Lol! Basically the level for this is swearing at the Polis when they talk to you in the street. It sticks out like a sore thumb as an insurance policy for PR purposes when the Judge rumbles the overcharge. Something like "Well we may have had all sexual assault charges dropped or dismissed but he was found guilty today, justice was served...
2. In general and not related to any particular case, don't be an internet conspiracy theorist, sometimes things come out when they come out and possible reasons for delay can be obvious.
3. The Scottish charge of breach of the peace is very different from the EW charge. Very much not (and specifically excluding) being rude to police.
4. 3 again being a general point because sub judice.
5. Walt, am I misusing sub judice, is that the right word for the first what you English might (I think?! Or maybe it's john grisham) call arraignment? Anyway, contempty shiz.
Not sure about overcharging Asti. Does each charge reflect a different complainant/event? I’m asking as I don’t know. The alternative option is several charges, or even all, relate to one complainant. It’s possible. I’ve drafted indictments which have had up to 20 odd counts to reflect different incidents on different dates but reflecting the same complainant or event. Sometimes it’s warranted for technical reasons.
Can a criminal bod with a sporran pls explain the difference between attempted rape and sexual assault? Is the former an inchoate offense so carrying the potential sentance of rape?
Assume any sentences would run concurrently rather than consecutively?
I am axg as a legal nerd - obv have no eye deer if he is guilty or possibly guilty or a victim of some conspiracy.
I suggest we let the courts decide this one. Any speculation as to his guilt or otherwise, or alleged cover-ups within the SNP, is just ill-informed gossip and shouldn't be appearing on a lawyers' discussion board.
