Currently reading this about the concussion problem in rugby (and also football).

Interesting.

I think it is an enormous scandal, tbh and one that could spell the end of professional rugby.

They should of course be suing the clubs (as employers) rather than the Unions. But the clubs haven't got any money/deep enough insurance policies.

They have massive problems with evidence (apparently they are claiming some players 'don't have any medical records) and also on causation.

Assuming that the claim is in tort, also volenti and contributory negligence appear to be in play.

Maybe, and for some players there will be other contributory proclivities and supplements that wI'll have to be discussed in evidence. 

But its still going to fuçk the sport for ever.

Or alternatively they just need to introduce weight limits on the players as it's only really become in issue in the modern era as professional players have had the time and resources to seriously bulk up and where for some players their ongoing success is now related to smashing into other players.

I'm sure a lot of players don't have any evidence as they will themselves have kept it quiet to be able to keep playing in a game.  We've all seen players who've clearly been out cold claiming they weren't and wanting to stay on the pitch and it's similar with the issue in the military where people have covered up injuries to continue with deployments so there are no records of them ever being injured so they can't claim in relation to those injuries.  It's especially bad in the US where the VA can only treat injuries documented in your service records and insurers won't cover anything that occurred while you are in the army.
