Weren't the judges that decided in the English High Court three of the most senior Law Lords? It seems unlikely that they would change their mind on appeal.

How can this have frustrated parliament when they got the Surrender Bill in?  Clearly it hasn't frustrated parliament at all.  It has frustrated the entire nation, but not parliament.

The "they got their way anyway" point is beyond stupid, as anyone who has ever been subjected to salesmanship will know that sales people's primary weapon is time-limiting a potential customer's decision. 

There was no objective reason to prorogue when such a significant set of political circumstances exists. The decision was pure gamesmanship to flush out what MPs would do and then use the subsequent time to de facto election campaign. It was a capricious decision so rightly subjected to JR.

I am sure next time the complainers are trying to get planning permission and the planning committee uses its discretion to refuse permission on a technicality they will go home and accept "defeat" as the price of democracy.

well, first of all he has already said he would be willing to defy the law by refusing to seek royal assent on a lawfully passed Bill

secondly, as above, I am not sure that ordering parliament to re-assemble is within the remedies available

Interestingly Bercow has said the government will need to recall parliament (i.e. he is not treating the prorogation as void as a result of this decision).

I suspect Corbyn will be furious.  I wouldn't be surprised if Boris does now recall parliament and insist on however many motions for a GE under the FTPA he can get in between now and October 19th , just so he can call Corbyn chicken every day.

This decision isn’t actionable as such nor does it bind the Supreme Court? Sumption knows the way his fellow law lords think and his view is it is unjusticable and that is likely to be the view of the SC.

i think the hearing has been set down for next week, does anyone know if all law lords will be sitting ? Lastly what is the remedy arising out of the Scottish case ?
