Maybe i jumped the gun and Cox's has dealt with it (relying on Twitter).  Pannick saying we wouldn't be trapped in backstop even if EU acted in good faith but no deal was reached - says we can invoke Art 62 of Vienna Convention to terminate WA

He's just talking sh1t here isn't he?  Its an essential part of Art 62 that the "fundamental change of circumstances" "was not foreseen by the parties".

HTF can you argue that a failure to agree and implementation of the backstop is "not foreseen" when we're spending so much time mithering on about the possibility of it?

Which is before you get to the point that the collapse of the USSR, end of Warsaw pact etc. failed to meet the test which all looks rather more material and unexpected than failing to agree a magical invisible border.
