Jonathan Sumption

Does it strike anyone else as inappropriate that he is all over the media, pre-judging the issue and telling everyone what he thinks the answer is?   There must at least be a risk that this will influence the court.

Yeah the Lord Justices of Appeal will base their deliberations on what he said to the press and not what he said on Court.... they are know for that sort of thing.

Wibble, they will not expressly base their decision on Sumption's view of course,  but he is probably considered the best lawyer and judge of his generation so I am afraid his view will carry some weight, even if only sub-consciously.

But if Sumption was a remainer saying that Boris was a charlatan who had no right to prorogue he'd no doubt be "brave and principled" in his musings to the press.

Sir Pitt did you see Newsnight last night he wasn't exactly complimentary about BJ.

Anyway he simply stated if SC takes the orthodox view then the case will fail.

Sumption is a remainer and evidently considers the current government "appalling".   He is welcome to express his views on the politics of it, but I don't think past supreme court judges should prejudge, without hearing all the argument, live issues to be heard before the current supreme court.

Obvi it will not influence the current judges. But previous judges certainly have kept a much lower profile, more in keeping with the way Judges have to be while sitting (ie radio silence in public aside from the odd lecture or book). It wouldn't surprise me if some of the previous generation thought that what Sumption is doing now is not the done thing. Heffa probably knows.

Lo @ sumption being the best lawyer or judge . As a bazza he was very good at self promotion. But he was one of a small number at the commercial bar who would be called upon for bet the farm type litigation. Don't think many would instruct him in a tax or criminal case....

Although you speak to ny number of solicitors, and Bazzas who he has lead, they will mostly say he isn't great at first instnance work, and has a habit of not taking judges and witnesses through in any great detail as he assumes they will know the point he is implying. He comes in to his( virtual) own doing commercial lit, in the appelate courts.

I doubt the SC judges are in awe of him. He in fact said when he was a SC Judge that the bench was of the very highest quality

I am sure eleven supreme court members will come to the correct decision, whichever way they decide.   I will not criticise a decision that the prorogation is not justiciable following full consideration of the arguments and the relevant law.    I only criticise a highly influential former judge prejudging the matter.

My view is the SC is likely to go with the government.   I am fine with that, I will not be fine with the lies the government will tell about (as they already have about the High Court decision) the court vindicating their appalling behaviour.
