Employment headz

Question. In a redundancy situation, is an employer required to consider offering suitable alternative employment in a group company located abroad?

The case law says that offering a redundant employee an alternative job in a group company CAN be a suitable.

It would depend on the facts, but I would be very surprised if a Tribunal were to find that an employer was obliged to offer suitable alternative employment outside of the UK, but it's possible if (for example) the employee had previously performed roles overseas and / or in other group companies.

OFC there is no obligation to offer assistance / relocation to such a role (unless it's been created by a policy of the employer) so you could offer the job if the facts were concerning, but no assistance to get there.

thanks Khashoggi. Could I message you privately to discuss a bit further?
