Weils lawyer costs Microsoft $40million

A judge added $40million onto a $290million judgment after accusing a Weil Gotshal lawyer of misleading the jury on a point of law.

Partner Matthew Douglas Powers was acting for Microsoft in a patent dispute when Judge Leonard Davis admonished him for "misstating the law" to a jury. He pulled Powers aside and said whilst "I don't want to embarrass you in front of the jury... I would appreciate it if you would clean that up".

However, Douglas didn't correct himself so the judge added $40million to the $290million that Microsoft had already been ordered to pay for patent infringement.

A spokesman for Microsoft said they would appeal the verdict. Weils declined to comment.
