A lawyer faces up to five months in jail after a cab driver filmed her hitting on him.

33-year-old Jennifer Gaubert from New Orleans told police that cab driver Hervey Farrell had surreptitiously filmed up her skirt without her permission, and then demanded large sums of cash in return for handing over the video. As a result Farrell was locked up for 27 hours, was humiliated on local media and lost his taxi licence.

Farrell's version of events is rather different. He claims that the lawyer was several sheets to the wind, kept hitching up her skirt and tried her best to get it on with him despite his protestations that he wasn't interested, before eventually falling out of the cab saying that his girlfriend was a very lucky woman. Charges against Farrell have now been dropped, and last week Gaubert was convicted of simple battery after touching the driver without his permission. Next month she faces more serious charges of making false statements, which carry a maximum sentence of five months jail.

Farrell has also filed a claim against both Gaubert and the New Orleans police.

Gaubert said that her behaviour was stupid but not criminal.
